1. General - DEFINITIONS

• In these terms and conditions “we” means Home Heat (Clayhill) Ltd.

• “Contract” shall mean the agreement between the client and Home Heat.

• “Works” or “installation” is the service carried out by Home Heat and its employees.

• “Quote” is a commercial statement detailing a set of products and services to be purchased in a single transaction by one party from another for a defined price.

• Any verbal comments made by the showroom staff, agents or installers, or any descriptions or illustrations contained in catalogues, price lists or other promotional material are intended to present a general idea of the service and shall not form any representation or be part of the works.

• Unless otherwise stated or agreed in writing between the parties, the contract shall be subject to and constructed and interpreted in accordance with English law and shall be subject to the exclusive jurisdiction of the courts of England

2. Quotations

• All prices stated include VAT, unless expressly stated otherwise.

• Quotations are valid for a period of 60 calendar days after which time they may be subject to alteration.

• Where quotations are based on details provided by the customer, such quotations are subject to the accuracy of those measurements and/or information.

3. Installation

• We will do all that we reasonably can to meet the date agreed for installation. However, in the case of unforeseen circumstances beyond our reasonable control we may not be able to do so. In such circumstances we will contact you to agree an alternative date. The customer will also do all that he/she reasonably can to enable the installation to take place on the given date. In the case of unforeseen circumstances beyond the customer’s reasonable control the customer should contact us to agree an alternative date.

• We will carry out any installation works described in the quote. If additional works not described in the quote are found to be necessary during the course of the installation, these works will be quoted for separately and only carried out with the customer’s permission.

• We will use reasonable measures to keep disruption to water, gas and electricity supplies to the minimum reasonably practicable.

• It is the customer’s responsibility to ensure that, prior to the installation works starting, all furniture is removed from the area of the installation and any carpet in the installation area is rolled back.

• Removal of any pre-existing unit or old fixtures may cause some damage to surrounding areas. The agreed price does not cover ‘making good’. Neither does it cover painting, decorating, fitting skirting board, tiling or cutting and fitting carpet, unless specifically stated in the quote.

• The client will ensure reasonable access to the property to ensure installation within a mutually agreed time period.

• Chimneys must be swept and inspected prior to installation of any appliance by a competent person/persons and to the National Association of Chimney Sweeps Code of Practice Amended & Approved 1999 Standard.

• In the event of any unforeseen structural problems after removal of any existing fireplace or opening of a chamber area etc. Home Heat reserve the right to access any such works, for additional costing whether by themselves or other designated parties. Home Heat will not be held responsible for any delay incurred in the installation due to any events of this nature.

• On rare occasions problems can arise during installation from unforeseen obstacles that were not apparent during your survey. For example, some existing chimney flues may have structural defects that cause fumes to enter the room, and we cannot guarantee that the installation of a new fireplace will rid you of the problem. Some chimneys may have obstructions that occur as part of the original building work, and can prevent successful installation of the flue liner. It also cannot be determined prior to installation whether there will be a problem with downdraft from the new system. In the unlikely event that any of these (or other) unforeseen incidents occur, we will immediately consult with you before proceeding any further. This can also add an unforeseeable amount of time to the completion date of your installation. We cannot be held responsible for this, but we will do our utmost to see that you are not inconvenienced for any longer than is absolutely necessary. In cases where building or planning permission is required, no work will be started or materials ordered until we have received written confirmation that the work has been approved.

4. Consents

• The customer is responsible for obtaining all necessary planning permission and local authority consents and permissions for the work to be carried out. In carrying out any work we will assume that the necessary consents and permissions have been obtained and we accept no responsibility whatsoever in the event that they have not.

5. Payment

• Payment for the installation works will be collected from the customer at the time of completion.

• Where several separate installation works are carried out at the same premises, payment for each individual installation will be collected from the customer at the time of completion.

• Works not paid for at the time of completion will have a further 14 days to settle the balance or the client will incur a penalty charge of 10% of the total cost.

• Payment must be made in full on the final day of completion of our work. We will charge £25.00 for every cheque returned by the bank for insufficient funds. If any legal action is brought by Home Heat to collect monies, the client will pay the face amount of the cheque plus interest there on at the rate of two per cent (2%) above base per month plus expenses incurred during collection.

6. Conditions and Warranties

• As with all natural materials such as real timber, marble, slate and granite, minor markings or unusual grain patterns may show. These are not defects but parts of the natural character of the piece. Made to Measure Mantels are made using kiln dried wood. It is natural that minor shrinkage may occur. This very rarely occurs as the kiln drying procedures are monitored carefully.

• Natural products may show some colour variations for which we take no responsibility.

• It is the client’s responsibility to insure the appliance receives regular maintenance.

7. Cancellation Charges

• A minimum of 25% cancellation charge will apply to all orders cancelled. This is at the Directors discretion.

8. Manufacturers Guarantee

• All goods carry a manufacturer’s guarantee (except showroom models). In the unlikely event that any fire, stove or fireplace has to be removed and refitted at any time under the guarantee or otherwise then Home Heat will not be responsible for any decoration or damage to wallpaper etc.

9. Cookie Directive

A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes within Google Analytics.
